1. Agreement to Terms

These Terms of Service ("Terms") form a legally binding agreement between you and RiskIT ("RiskIT," "we," "us," or "our"), a social party-game application operated by Israel Diaz, Founder and Developer of RiskIT, as an individual sole proprietor based in California, United States. These Terms govern your access to and use of the RiskIT mobile application and the website at https://risk-it-app.com (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Definitions

• "Account" means the personal account you register to use RiskIT.
• "Content" means any text, images, or other material available through the Service.
• "User Content" means Content you create or submit, including custom Stakes and your profile picture.
• "Stake" means a dare, challenge, or forfeit that is either generated by our AI features or created by a user.
• "Game Mode" means one of the pass-the-phone game formats offered in the App.
• "Premium" means the paid subscription tier described in Section 10 and our Subscription Terms.
• "Friend" means a user you connect with for leaderboard purposes.

3. Eligibility

You must be at least 17 years of age to create an Account or use the Service. By using RiskIT, you represent and warrant that you are 17 or older, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under the laws of the United States or your state of residence. RiskIT is currently offered in the United States only.

4. Accounts

To use most features, you must create an Account using a valid email address and password. You may also provide a profile picture, a display name, and, for verification and security only, a phone number. You agree to provide accurate information and to keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. Notify us immediately at support@risk-it-app.com if you suspect unauthorized use of your Account. You may not share your Account, create an Account for anyone else, or maintain more than one Account to evade enforcement action.

5. The Service & Gameplay

RiskIT is a social party game designed to be played among friends. The Service includes four pass-the-phone Game Modes in which players take turns on a single device, AI-generated and user-created Stakes, friend connections, and friend leaderboards. Friend features are provided for the purpose of comparing scores on a leaderboard; RiskIT is not a messaging platform, and friend connections do not create private chats. We may add, change, or remove features, Game Modes, or Stakes at any time.

6. AI-Generated & User-Created Stakes

RiskIT offers Stakes that are (a) generated automatically by artificial intelligence and (b) created by users. Stakes are provided for entertainment purposes only. AI-generated Stakes are produced by automated systems and may occasionally be unexpected, inappropriate, or unsuitable for your situation. You are solely responsible for deciding whether to attempt any Stake. Your use of Stakes is additionally governed by our AI Challenge Disclaimer, which forms part of these Terms. Do not attempt any Stake that is unsafe, illegal, or beyond your physical ability, and always use good judgment and consideration for those around you.

7. User Conduct

You agree not to use the Service to:

• Create, submit, or encourage Stakes or Content that are dangerous, illegal, harmful, hateful, harassing, sexually explicit, or that promote self-harm or violence;
• Harass, bully, threaten, impersonate, or intimidate any person;
• Upload a profile picture or Content that infringes others' rights, is obscene, or violates our Community Guidelines;
• Collect or misuse other users' information, or use the Service to contact users who have blocked you;
• Attempt to gain unauthorized access to the Service, other Accounts, or our systems;
• Reverse engineer, decompile, scrape, or interfere with the Service or its security features;
• Use bots, automation, or exploits to manipulate leaderboards or gameplay; or
• Violate any applicable law or the rights of any person.

Your use of the Service is also governed by our Community Guidelines, which are incorporated into these Terms.

8. User Content & License

You retain ownership of the User Content you create, including custom Stakes and your profile picture. By submitting User Content, you grant RiskIT a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, store, reproduce, display, and use that User Content solely to operate, provide, and improve the Service. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law. We may remove User Content that violates these Terms or our Community Guidelines at any time.

9. Reporting, Blocking & Enforcement

RiskIT provides tools to report and block other users. We review reports and may, in our discretion, remove Content, issue warnings, restrict features, or suspend or terminate Accounts that violate these Terms or our Community Guidelines. We do not tolerate objectionable content or abusive users, and we reserve the right to act on reports promptly. Blocking a user prevents that user from connecting with you or appearing on your leaderboard.

10. Subscriptions & Payments

RiskIT offers an optional Premium subscription at $2.99 per month or $19.99 per year (prices in U.S. dollars, exclusive of any applicable taxes). All purchases are processed by Apple through Apple In-App Purchase and are managed with the help of RevenueCat. Subscriptions renew automatically unless canceled. The full terms that apply to your subscription, including auto-renewal, cancellation, and price changes, are set out in our Subscription Terms, and refunds are governed by our Refund Policy. Both are incorporated into these Terms.

11. Intellectual Property

The Service, including the RiskIT name, logo, software, game designs, AI-generated Stakes, text, graphics, and all related intellectual property, is owned by RiskIT or its licensors and is protected by United States and international intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service except as expressly permitted.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, RiskIT disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any Stake is safe, appropriate, accurate, or suitable for you. Any material you access through the Service is accessed at your own discretion and risk.

14. Limitation of Liability

To the fullest extent permitted by law, in no event will RiskIT, Israel Diaz, or any related party be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or personal injury, arising out of or relating to your use of or inability to use the Service, any Stake, or any User Content, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of RiskIT for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to RiskIT in the twelve (12) months before the event giving rise to the claim, or (b) twenty U.S. dollars (US$20). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction there.

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@risk-it-app.com. We will try in good faith to resolve the dispute for at least thirty (30) days.

15.2 Binding Arbitration

Except for small-claims matters and claims for injunctive relief, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in California, rather than in court. You and RiskIT waive the right to a trial by jury.

15.3 Class-Action Waiver

You and RiskIT agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration and class-action waiver within thirty (30) days of first accepting these Terms by emailing support@risk-it-app.com with the subject line "Arbitration Opt-Out."

16. Termination

You may stop using the Service and delete your Account at any time (see the Privacy Policy for deletion instructions). We may suspend or terminate your Account or access to the Service at any time, with or without notice, if you violate these Terms, our Community Guidelines, or applicable law, or to protect the Service or other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and dispute resolution — will survive.

17. Apple App Store Additional Terms

Because RiskIT is distributed through the Apple App Store, the following applies: (a) these Terms are between you and RiskIT only, not with Apple, and Apple is not responsible for the Service or its content; (b) your license to use the App is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service; (c) Apple has no obligation to provide maintenance or support for the App; (d) Apple is not responsible for addressing any claims relating to the App, including product-liability, legal-compliance, or intellectual-property claims; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide additional notice through the App or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. General Provisions

These Terms, together with the Privacy Policy, Community Guidelines, Subscription Terms, Refund Policy, and AI Challenge Disclaimer, constitute the entire agreement between you and RiskIT regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. Nothing in these Terms creates any partnership, agency, or employment relationship.
